Noisy Westward Ho! resident fined again

In 2018 Mathew Clark from Westward Ho! was fined £1,668 by the courts and had TVs and sound equipment confiscated twice for noise disturbance making his neighbours lives a misery. Despite this and instructions by the Courts and Torridge officers to improve his behaviour he continued to ignore all warnings and previous Community Protection Notices served on him.


Following Mr Clark’s refusal to abide by any of the Court’s rulings, Council Officers prepared a prosecution case for repeated contraventions of the noise abatement orders. The case was heard in court on Tuesday and Mr Clarke was ordered to pay a further fine of £500, a victims surcharge of £30 and costs of around £1,100. This brings the total fines and other costs imposed to £3,305, on top of having his equipment confiscated on numerous occasions.


A criminal behaviour order was also made which will require Mr Clark to attended an Alcohol Treatment Programme for assessment and further referral. His attendance will be supervised by Torridge Council and the order also prohibits Mr Clark from creating any further noise disturbance or from contacting his neighbours either in person or through other means. If Mr Clark fails to comply with all of the provisions of the order then he will be committing a criminal offence for which he could be sent to prison.


Lead member for the Environment – Councillor Ken James said: “Despite warnings to moderate his behaviour, substantial court fines and previous confiscation of equipment it seems Mr Clark has refused to acknowledge that his behaviour towards his neighbours is unacceptable and will not be tolerated. I am very pleased that our officers have acted quickly to follow up on the continued nuisance this resident has caused, supported by the courts and the police. The criminal behaviour order will force Mr Clark to face up to his actions and take responsibility for them. We hope that this will give his neighbours some respite from the appalling behaviour they have been forced to endure.”
